• Other authorised representatives

Aframena does not claim to be a licensed property broker in every country in which a property is displayed.

Where local brokerage or regulated services are required, those services may be performed by an appropriately authorised third party.

4. Aframena Stays

Aframena Stays is a marketing and enquiry service within Aframena Properties.

Unless expressly confirmed otherwise in writing, Aframena Stays does not:

• Manage the property
• Set property availability
• Determine pricing
• Enter into the guest booking contract
• Collect the guest's booking payment
• Set cancellation terms
• Process refunds
• Provide on-site guest services
• Control the owner's or operator's conduct

The relevant owner or operator remains responsible for:

• The property
• Pricing
• Availability
• Licensing
• Booking terms
• Payments
• Cancellations
• Refunds
• Guest communication
• Property preparation
• Guest support
• The guest experience

5. No confirmed booking through an enquiry

Submitting an enquiry does not create a confirmed booking.

A booking is only confirmed when the relevant owner or operator confirms it in accordance with its own terms.

Unless Aframena expressly agrees otherwise in writing:

• The booking contract is between the guest and the owner or operator
• The owner or operator sets the payment terms
• The owner or operator sets the cancellation terms
• The owner or operator handles refunds
• Aframena does not guarantee availability
• Aframena does not guarantee that an enquiry will be accepted

Users must review the owner's or operator's booking terms before paying or confirming a stay.

6. Property information

Property information may be supplied by:

• Owners
• Operators
• Developers
• Agents
• Brokers
• Other authorised representatives

Aframena may review property information for presentation, consistency, authority or suitability. Such review does not constitute a legal, technical, structural, financial or regulatory verification of every statement made by an owner, operator, developer, agent or other third party.

Users should independently verify information that is material to a booking, purchase, lease, investment or other transaction.

However, property information may change. This may include:

• Prices
• Availability
• Dimensions
• Floor areas
• Specifications
• Amenities
• Completion dates
• Payment plans
• Service charges
• Rental returns
• Photographs
• Views
• Furnishings
• Legal status
• Licence status

Users should independently verify information material to their decision.

Nothing on the website should be treated as a binding representation unless expressly confirmed in writing by an authorised party.

Acceptance must be confirmed in writing.

Payment of a fee does not guarantee acceptance unless Aframena has confirmed acceptance in writing.

Partnership, listing, editorial or campaign fees do not guarantee:

• Website traffic
• Enquiries
• Bookings
• Revenue
• Property sales
• Investment outcomes
• Media coverage
• Social-media reach

Promotional placement remains subject to:

• The agreed scope
• Availability
• Editorial discretion
• Campaign timing
• Property relevance

Separate partnership terms may apply.

11. User responsibilities

Users must:

• Provide accurate information
• Keep material information current
• Have authority to submit property information
• Have permission to provide photographs and documents
• Avoid misleading claims
• Avoid impersonating another person
• Avoid unlawful activity
• Avoid uploading malicious files
• Avoid interfering with website security
• Avoid unauthorised scraping
• Avoid harvesting personal information
• Avoid copying protected content without permission
• Avoid infringing intellectual-property rights
• Avoid submitting duplicate or deliberately misleading listings
• Avoid using enquiry forms for spam or unrelated commercial solicitation

Users must notify Aframena if submitted information becomes materially inaccurate.

12. Uploaded content

• Supporting documents

The person submitting the material confirms that they:

• Own it, or
• Have permission to submit it, and
• Have authority to allow Aframena to use it for the relevant purpose

Users retain ownership of their original material.

For application-review purposes, the user grants Aframena a limited, non-exclusive licence to:

• Review the material
• Store it for the application process
• Assess the property
• Communicate internally about the application

For an accepted property, the user may grant Aframena a further limited licence to:

• Prepare the listing
• Publish agreed marketing material
• Promote the property
• Display the property within agreed campaigns
• Use the material for the agreed partnership period

Sensitive verification documents are not included within the public marketing licence.

Aframena may create reasonable technical versions, crops, thumbnails, responsive formats and editorial adaptations of accepted marketing material where necessary to display or promote the property within the agreed scope.

Aframena will not materially alter the meaning of submitted property information without reasonable basis or partner consultation where appropriate.

Aframena will not claim ownership of user-submitted material.

13. Intellectual property

Unless otherwise stated, the following are owned by or licensed to Aframena:

• Aframena brand names
• Aframena logos
• Website design
• Original website copy
• Graphics
• Original photographs
• Page layouts
• Databases
• Software
• Code
• Marketing materials

Users may browse and use the website for lawful personal or business-enquiry purposes.

Users may not, without permission:

• Republish substantial website content
• Reproduce the design
• Use Aframena branding
• Copy databases
• Scrape listings
• Sell or commercially exploit website content
• Remove copyright or trademark notices

Nothing in these terms prevents lawful linking, quotation or use permitted by applicable law.

14. Automated access, scraping and database use

Users must not, without Aframena's prior written permission:

• Use bots, crawlers, scrapers, spiders or automated tools to access or extract website content
• Systematically copy property listings, images, descriptions, prices, contact details or market information
• Build, populate, train or enrich a competing property database, portal, search tool, artificial-intelligence system or commercial service using Aframena content
• Circumvent technical access controls, rate limits or security measures
• Harvest personal or business contact information
• Reproduce substantial parts of the website database
• Monitor the website in a way that places an unreasonable load on its systems
• Use Aframena listings to contact owners, operators, agents or developers for unauthorised commercial solicitation
• Remove copyright, ownership or attribution notices

Normal indexing by recognised public search engines is permitted where it complies with Aframena's robots instructions and does not reproduce or commercially exploit substantial website content.

Aframena may restrict or block automated access where reasonably necessary to protect its systems, content, users and commercial relationships.

Nothing in this section prohibits lawful quotation, linking, research or uses permitted by applicable law.

15. Third-party websites and services

17. Content moderation and removal

Aframena may edit, correct, restrict, suspend, unpublish or remove website content where reasonably necessary because of inaccuracy, expired availability, legal concerns, third-party rights, suspected fraud, security, quality standards, commercial relevance or breach of applicable terms.

Where appropriate, Aframena may request clarification or updated information before taking action.

Removal from the website does not by itself determine contractual refund or termination rights. Those matters are governed by the applicable written agreement.

18. Security

• Circumvent access controls
• Interfere with website operation

Users who believe a property listing, owner, operator, agent, developer, enquiry or communication may be fraudulent, misleading, unauthorised or unsafe should contact Aframena promptly.

Report concerns by emailing sales@aframena.com with the subject line “Suspected fraud or listing concern”.

Please include, where available:

• The property URL
• The name of the person or company involved
• Relevant messages
• A description of the concern
• Supporting screenshots or documents

Do not send passwords, complete payment-card details, bank login credentials or unnecessary identity documents.

Aframena may review, restrict, suspend or remove content while a concern is investigated. Aframena is not required to disclose confidential investigation details or internal review notes.

Reporting a concern does not guarantee a particular outcome and does not replace contacting the police, bank, payment provider or relevant authority where urgent action is required.

20. Payment safety

Before sending money in connection with a property, users should confirm the identity and authority of the person requesting payment, verify the payment instructions and review the applicable booking or transaction terms.

Users should be cautious where payment instructions change unexpectedly, where payment is requested to an unrelated account or where pressure is applied to transfer funds without appropriate documentation.

Aframena does not currently process guest booking payments through Aframena Stays unless expressly stated otherwise.

21. Electronic communications

When a user submits a form, sends an email, communicates through WhatsApp or otherwise contacts Aframena electronically, Aframena may respond using the contact details provided.

Service-related messages may include enquiry responses, application updates, appointment information, property information, administrative notices and security communications.

Optional marketing communications remain subject to the Privacy Policy and applicable marketing preferences.

Users are responsible for ensuring that the email address and telephone number they provide are accurate and monitored.

Formal contractual notices remain governed by the relevant signed agreement and are not necessarily satisfied by every electronic communication.

22. Liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

This includes liability for:

• Fraud
• Fraudulent misrepresentation
• Deliberate misconduct
• Any other liability that cannot legally be excluded

To the extent permitted by law:

• Aframena is not responsible for decisions made solely on the basis of general website information.
• Aframena is not responsible for independent acts or omissions of owners, operators, developers, agents, payment providers or booking providers.
• Aframena is not responsible for changes to property prices, availability, specifications or market conditions outside its reasonable control.
• Aframena is not responsible for indirect or consequential losses arising solely from ordinary website use where such exclusion is lawful.
• Separate paid-service agreements may contain different liability provisions, and those provisions will apply to the relevant service.

23. Indemnity

To the extent permitted by law, a user may be responsible for reasonable losses or third-party claims arising directly from:

• Content submitted without authority
• Deliberately false information
• Infringement of intellectual-property rights
• Unlawful website use
• Fraudulent conduct
• Malicious files uploaded by the user

This clause does not create an unlimited indemnity and does not apply to loss caused by Aframena's own fraud, deliberate misconduct or unlawful conduct.

24. Suspension and termination

Aframena may restrict or suspend access where reasonably necessary because of:

General website suspension does not by itself determine whether a commercial fee is refundable.

Fees, termination rights and refunds are governed by the applicable written agreement.

Use of personal information is governed by the Aframena Privacy Policy.

Use of cookies may also be governed by a separate Cookie Policy or cookie-consent notice.

26. Changes to these terms

We may update these Website Terms and Conditions.

The current version will show the latest revision date.

Where required, we may provide additional notice of material changes.

Changes will not retrospectively replace the terms of a separately signed agreement unless that agreement permits the change.

27. Governing law and jurisdiction

These Website Terms and Conditions, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of the United Arab Emirates.

Subject to any mandatory consumer-protection or jurisdictional rights that may apply, the courts of Dubai, United Arab Emirates shall have jurisdiction over disputes arising from or connected with use of this website.

Where a separate brokerage, advisory, listing, application, partnership or service agreement applies, the governing-law and dispute-resolution provisions in that agreement will prevail for that service.

28. General

If any provision is found unenforceable, the remaining provisions continue in effect.

A delay in enforcing a right does not waive that right.

Users may not assign rights arising under these website terms without consent where consent is legally required.

Aframena may transfer website operations or contractual rights as part of a genuine business restructuring, sale or transfer, subject to applicable law.

No third party has a right to enforce these terms unless expressly stated or legally required.

Separate written agreements prevail over these website terms in relation to the services covered by those agreements.
